April 29, 2024 – In June 2018, Attorney Jeff Morneau filed a civil lawsuit alleging violations of state and federal labor laws on behalf of Arletta Mongue, former waitstaff at the 5-star hotel and restaurant in Berkshire County, Massachusetts, The Wheatleigh. This action was initially brought for Ms. Mongue’s individual claims but became a class action in September 2021.
On April 16, 2024, after nearly six years of litigation, U.S. District Court Judge Katherine A. Roberston granted Plaintiff’s Motion for Final Approval and Plaintiff’s Motion for Attorneys’ Fees and Expenses and ordered Defendants to issue the Class a total of $277,106.00 for unpaid tips, overtime and minimum wages. Defendant Linfield Simon has publicly commented that he plans to appeal this ruling to the U.S. First Circuit Court of Appeals in Boston.
